YOUSEND REFERRAL TERMS

Introduction

YouSend Inc. (“We”, “Us”, “YouSend”) is at the centre of influencing positive change in remittance globally and we invite you to participate in this quest with us, for a reward. YouSend offers its Customers on its YouSend Platform the opportunity to earn bonuses and rewards from referring the product to another paying customer (“Referral Reward”).

Important information

This Referral Reward is solely at YouSend’s discretion and subject to the terms and conditions set out below.

Eligibility Requirements

Referral Reward Eligibility - Inviter: To be eligible for the YouSend Referral Reward program, you have to meet the criteria set out below;

  1. Have a valid and active YouSend Account at the time of participating in the YouSend Rewards Program;
  2. Share a logged invitation respectively using the special codes or URL provided on the YouSend platform.

Referral Reward Criteria:

  1. Invitee must not have an existing YouSend account under their actual name or a pseudonym;
  2. Invitee must sign up for a new YouSend account using a valid phone number via the referral link sent by the Referrer provided that;
    1. phone number, device ID or email address must not have been previously associated with any existing YouSend account; and
    2. Phone number or email address of the Invitee has been verified on the YouSend platform, or they have been invited to complete any other verification steps as deemed necessary under the YouSend Terms of Use, User Agreement or such other binding legal agreement.
  3. The Invitee must use the YouSend app to make a minimum qualifying payment of: (Insert the minimum payment amount)
  4. Sign-up bonuses, promotional rewards (e.g., £5, $10, or 10 CAD), or any other type of marketing bonuses do not count toward the qualifying transfer amount required for eligibility for cashback or rewards.

Additional Terms

One-Sided Rewards

The Referral Rewards is a one-sided program that benefits only a current YouSend Personal Account Customer (the “Inviter”) and not the person or business that is being referred (the “Invitee”).

Only active personal accounts may participate in and benefit from the Rewards program.

Corporate accounts or operators of corporate/business accounts do not qualify for the Rewards program. If a Referral Reward has been previously issued to you under the pretext that your account qualifies but it is later discovered to be a corporate account or managed on behalf of a business, YouSend reserves the right to revoke the Referral Reward and deduct any such amount paid to you from your account.

Inviter account must be active during the referral and reward period

YouSend reserves the right to not issue a Referral Reward for any Inviter account that is not active during the referral and reward period.

Competing Invitations 

In the event that there is a competing invitation from two Inviters, YouSend reserves the sole discretion to determine which of the invitations qualify for the Referral Rewards.

Payments or Transfers between Invitee and Inviter do not qualify for rewards under this Referral Reward Program.

Where there is a Referral Reward for a minimum spend or transfer, the Inviter shall not be rewarded for transfers to the Invitee or between themselves and the Invitee.

YouSend reserves the right to withdraw the participation and the Referral Reward of any Inviter and take such further action including but not limited to closure of their account where there is reasonable suspicion of fraudulent activity aimed at  manipulating the promotion program for financial gain.

Timeline of the YouSend Rewards Program

The YouSend Rewards Program shall run for a specific time frame which we shall disclose in the YouSend application for potential participants (“Promotion Period”). Inviter shall only qualify for the Referral Reward if they complete the required steps during this Promotion Period.

In the event that we extend the timeline for the Invitee to complete the required steps, the notification shall be contained in the invite shared with the Invitee on the YouSend application.

We reserve the right to modify, suspend, or terminate the Promotion before the end of the Promotion Period if, in our reasonable judgment, the Promotion is being abused, could harm YouSend's goodwill or reputation, or if unforeseen circumstances arise that make it impossible to continue. This may apply to individual participants or the Promotion as a whole.

Use of Referral Rewards

  1. Referral Rewards earned through the program may be subject to additional terms and conditions. In general, rewards are non-transferable, non-refundable, and cannot be exchanged for cash unless explicitly stated.
  2. Referral Rewards may only be used within the YouSend platform to offset transaction costs.
  3. We reserve the right to cancel or withhold any Referral Rewards if we believe a violation of these terms has occurred, or if the reward was earned through fraudulent, illegal, or unethical means.

Variation in Reward Amounts

We reserve the right to change, modify, or vary the amount and structure of the Referral Rewards provided under the reward program, at our sole discretion, without prior notice to you. Such changes may include, but are not limited to:

  1. Alterations to the reward amount (e.g., increasing or decreasing the value of the reward);
  2. Introducing different types of rewards (e.g., cash, gift cards, discounts, etc.);
  3. Changing eligibility criteria for rewards;
  4. Terminating specific rewards for certain periods or indefinitely.
  5. Any changes to the rewards structure will be posted on our website or communicated directly to participants via email or other means, and the changes will take effect as of the date specified in such notice.

By continuing to participate in the reward program after any such variation or change, you acknowledge and agree to the new terms governing the rewards.

Privacy

We may process your personal data in accordance with our Privacy Notice in furtherance of this rewards program. By participating in the program, you consent to the collection, use, and sharing of your personal data as necessary for the administration of the program.

Limitation of Liability

YouSend is not responsible or liable for any issues related to the reward program, including but not limited to the following:

  1. Any email, reward, referral, or program-related materials or correspondence that are lost, fraudulent, abusive, stolen, late, incomplete, illegible, interrupted, delayed, altered, defective, misdirected, tampered with, or otherwise irregular in any way;
  2. Any failure of a participant’s email address, valid account, or other contact information, including situations where such information is deleted, changed, or becomes invalid without prior written notice from the participant to YouSend;
  3. Any technical issues, errors, or delays that may prevent the proper execution or processing of the reward program activities or communications;
  4. Any failure or delay in the delivery of rewards or notifications due to incorrect or outdated contact information provided by the participant.

By participating in the Program, each participant acknowledges and accepts that YouSend is not responsible for any of the above circumstances, and agrees to hold YouSend harmless in case of any such issues.

Governing Law

This Referral Reward program is governed by and may be construed in accordance with the laws of the Federal Republic of Nigeria.
